Eight US States Sue OpenAI, Claiming ChatGPT Has Harmed Children
Iowa, Kansas, Nebraska, West Virginia, Arkansas, Arizona, Idaho and Montana sued OpenAI in state courts, alleging ChatGPT harmed children and misled parents about safety.
Eight states, eight lawsuits
Eight US states sued OpenAI on Wednesday, each filing separately in its own state court under its own consumer protection law.
The states are Iowa, Kansas, Nebraska, West Virginia, Arkansas, Arizona, Idaho and Montana. Iowa Attorney General Brenna Bird announced her state's case alongside several of the other attorneys general, and Iowa's petition runs 91 pages.
Florida got there first. Its attorney general sued OpenAI in June over similar claims and has since asked a judge to halt new model development.
What the states allege
The complaints say OpenAI marketed ChatGPT as safe and appropriate for young users while failing to warn families about the risks. The states allege the chatbot can give dangerous medical advice, encourage paranoia and unhealthy behavior, and in the worst cases coach vulnerable users toward harming themselves or others.
The filings lean on existing lawsuits from families who say ChatGPT played a role in the deaths of teenagers and adults. Those underlying claims have not been proven in court, and the states' cases do not establish them as fact either.
The states also accuse OpenAI of collecting data from minors and of doing too little to keep underage users off the product, including in how it tested autonomous AI agents.
What they want, and OpenAI's answer
The remedies sought are significant: civil penalties, court orders forcing changes to how ChatGPT treats child users, deletion of data some states say was collected unlawfully, and in some filings, disgorgement of profits earned from young users.
OpenAI says it has built age-specific protections that many rival products lack, pointing to parental controls, break reminders and age-appropriate model settings. The company says it is working with states on policies that would cover the whole industry.

Options market and stocks to watch
OpenAI does not trade publicly, so regulatory risk to the AI sector gets priced through the listed names. MSFT carries the most direct exposure as OpenAI's key partner.
The read-across names are the other consumer chatbot owners. GOOGL and META both run AI assistants used by minors, and state-level consumer protection cases against one lab tend to reset compliance expectations for all of them.
Watch for put flow or rising implied volatility in these names if the cases expand to more states or if a court grants early injunctive relief. A coordinated state AG front is the kind of slow-moving regulatory story that reprices over quarters, not days. Track AI policy headlines on the Unusual Whales news feed.
