Florida just drew a hard line on how welfare cash can be spent, and the Trump administration wants the rest of the country to copy it. The state is blocking recipients from using cash-assistance benefits loaded onto EBT cards for purchases like tattoos, theme park tickets, video games, vaping products and other items not generally considered “basic needs.”

What the new rules actually do

Florida is amending its Temporary Assistance for Needy Families (TANF) State Plan to prohibit residents from using Temporary Cash Assistance (TCA) on “inappropriate, luxury, and non-essential items.” The prohibited list is broad and item-level, not just merchant-level.

Florida had already barred EBT cards from being used or accepted for alcohol purchases and transactions at adult-entertainment establishments, casinos and commercial bingo locations several years ago, but the updated plan moves beyond those merchant and location-based restrictions by imposing item-level limits at otherwise eligible retailers, including on purchases for tattoos and other body piercings, entertainment services and products like theme park admission and video games, intoxicants like vapes and other nicotine products, and pornography products.

How the program is funded

Florida’s cash-assistance program, known as Temporary Cash Assistance (TCA), is funded through the federal Temporary Assistance for Needy Families (TANF) program. It is separate from SNAP, the food-assistance program, though families may receive both types of benefits through separate balances on the same EBT card.

The Department of Health and Human Services’ Administration for Children and Families (ACF) determined Florida’s updated TANF plan to be complete Thursday in a letter sent to Gov. Ron DeSantis.

Why it matters beyond Florida

The plan is a first-in-the-nation model that Trump wants other states to follow. If red states copy the framework, the addressable market for a chunk of discretionary retail categories tied to lower-income spending could tighten at the margin.

By combining dietary rules with wider exclusions on entertainment tickets, body piercings and nicotine devices, Florida has become the first state in the US to enforce item‑level checkout restrictions on cash welfare. Enforcing the restrictions requires cooperation between state agencies, card processors and retail businesses.

The SNAP tie-in

The updated rules follow Florida’s separate Healthy SNAP initiative from April, which stopped families from spending food benefits on soft drinks, energy drinks and ultra-processed sweets. Taken together, Florida is building a template that touches both food and cash benefits.
