“I stand by my decisions as special counsel, including my decision to bring charges against President Trump,” Smith said in his opening statement. “I made those decisions without regard to President Trump’s political association, activities, beliefs, or candidacy in the 2024 presidential election.”

The underlying cases

In 2023, Smith ultimately brought two criminal indictments against Trump: one for his alleged attempts to subvert the 2020 presidential election and a second for his handling of classified documents while out of office. Both cases were wound down after Trump’s 2024 election win.

“Rather than accept his defeat in the 2020 presidential election, President Trump engaged in a criminal scheme to overturn the results and prevent the lawful transfer of power,” Smith said. Trump has consistently denied wrongdoing.

Smith was questioned about accessing basic phone records from lawmakers around the January 6, 2021, Capitol attack, with one Republican senator, John Kennedy, telling him bluntly: “You make me want to throw up in my mouth.” Smith has confirmed that his special counsel’s office sought records of members of Congress’ call logs — a lawful effort typical of federal criminal investigations, but criticized by members.
