The US State Department is vowing a “whole-of-government response to systematically disable” the ICC’s ability to operate.

The campaign was announced in a news release on Monday, accompanied by a video statement from Rubio and an op-ed in the Wall Street Journal. Rubio urged other countries to join the effort as the Trump administration significantly escalates its campaign against the global institution.

Why Now

The administration’s ire against the ICC goes back to Trump’s first term, when it targeted the ICC for seeking to investigate alleged war crimes committed by US forces in Afghanistan. The second Trump administration has imposed a slew of sanctions against ICC officials for their attempts to investigate the US and Israel.

The administration has taken several actions that international law experts have said could eventually be investigated, including during the US-Israel war with Iran, strikes on alleged drug smuggling boats in the Caribbean, and the abduction of Venezuelan leader Nicolas Maduro. The court has taken no steps to investigate US personnel in recent years.

Last month, three International Criminal Court judges sued Trump and his administration over sanctions imposed on them last year, arguing the measures were unlawful. ICC spokesperson Oriane Maillet said the court would not comment on the matter at this stage.
