Trump Has Declined to Rule Out Declaring a National Emergency Related to the 2026 Midterms
'I don't rule anything out or in'
President Trump has declined to rule out declaring a national emergency related to the 2026 midterm elections, per Reuters. In a Time magazine interview published in October, Trump left the possibility open. "I don't rule anything out or in," he said. "We'll see."
Allies pushing, lawyers skeptical
Some Trump allies have urged him to consider declaring a national emergency over alleged voter fraud or foreign election interference, arguing it could provide a basis for greater federal involvement in how votes are counted, including requiring hand counts. Many legal experts say an emergency declaration would not give the president constitutional authority to take over the administration of elections, which is largely a state responsibility, but warn that an attempt could trigger confusion, litigation and delays in certifying results while courts sort out the limits of presidential power.
In the same interview stretch, Trump also declined to rule out invoking the Insurrection Act around the midterms, saying he had never used it but "could use it." Asked about concerns that the administration could invoke emergency powers in connection with the election, the White House did not directly address the scenario; spokesperson Lauren Bis instead defended the administration's election-security agenda, arguing voter-ID requirements and efforts to prevent noncitizen voting are needed to strengthen public confidence. Separately, a separate national emergency concerning foreign election interference was continued on August 31, and the midterm vote itself is set for November 3, 2026.

Options market and stocks to watch
Election-mechanics risk is volatility risk. A contested certification path or emergency litigation around November 3 is the kind of headline that lifts VXX and index put demand in SPY and QQQ, while prediction-market and event-driven names wear the speculation directly. Prediction markets have kept a contract on a pre-midterm emergency declaration trading at a meaningful probability for weeks, per market pricing.
