China Implements 20% Tax on Offshore Trusts

China has initiated a 20% individual income tax on offshore trusts, targeting assets transferred into these structures and the income they generate. This move aims to close loopholes that allowed wealthy citizens to shield assets abroad.

Taxation Details

Effective immediately, Chinese tax residents must pay a 20% tax on the appreciation of assets—such as shares, property, or other holdings—when transferred into offshore trusts. Additionally, income generated by these trusts will be taxed annually at the same rate. This applies to both existing and new trusts.

Compliance Measures

Authorities have provided a 90-day amnesty period for individuals to disclose and settle unpaid taxes on assets placed in trusts since January 2023, as well as on trust income received before 2026. During this period, late-payment penalties will be waived. Failure to comply may result in back taxes, surcharges, and fines.
